- We have extensive experience in representing insurers on market conduct and financial examinations, rate and form filings, consumer complaints, mergers and bulk reinsurance transactions, holding company act filings, rehabilitation, liquidation and other wind-up of affairs, re-domestications and numerous other regulatory matters. Representative clients include major insurers in all lines, individual agents and both local and national brokerage firms, premium finance companies, TPAs, health maintenance organizations and dental service companies.
- Represented the rehabilitator and liquidator of Kentucky's then-largest domestic insurance company as lead counsel. The firm's work included drafting the plan of liquidation and reinsurance; pursuing third-party claims against former officers, former directors, attorneys, appraisers and auditors for breach of fiduciary duty; and defending a putative class action securities litigation arising out of the company's collapse. This multi year representation included negotiation of a billion dollar reinsurance plan and participation agreement with 49 state guaranty associations.
- Stites & Harbison is representing a substantial group of creditors seeking to recover losses from a failed workers compensation insurer.
- Our lawyers handled the merger of the Kentucky Blue Cross/Blue Shield with Anthem (then Associated) and obtained Kentucky Office of Insurance regulatory approval of the Anthem demutualization.
- We represented a number of reinsurers and retrocessionaires in the Delta America Re liquidation.
