- Represent industrial packaging company Exel, Inc., in multi-million dollar insurance coverage litigation arising out of the catastrophic explosion of the CTA Acoustics facility in Laurel County, Kentucky, that caused multiple deaths of and injuries to CTA employees.
- In an appellate representation, the firm was engaged post-verdict to appeal a $3.57 million judgment against Haven Steel Products arising from the near amputation of a farmer’s leg by a field mower.
- Counseled a major manufacturing company on an intellectual property protection program.
- Handled one of the biggest mark transfers ever for ELECTROLUX.
- Assisted in the firm's landmark defense of Goodyear Tire in Goodyear Tire and Rubber Co. v. Thompson. In that case, the Kentucky Supreme Court became the first high court in the nation to apply the KUMHO Tire as well as the Daubert Standard to expert testimony.
- Presented oral arguments before the U.S. Supreme Court in Intel Containers International Corp. v. Huddleston, 113 S.Ct. 1095 (U.S. 1993), a constitutional challenge to Tennessee's sales and use tax scheme.
- Successfully defended breach of contract claim and pursued counterclaim for contract damages in dispute between two business entities for component parts.
- Represented American Institute of Steel Construction in extended evidentiary hearings before the U.S. Department of Labor. These hearings were held in connection with proposed OSHA regulations affecting the fabricated structural steel industry.
- Represented Kentucky automotive parts manufacturers to establish facilities, including an accounts receivable securitization facility and a synthetic lease transaction.
- Represented the Kentucky Cabinet for Economic Development in its attempt to secure a foreign automotive manufacturer in a billion dollar transaction.
- Successfully tried a claim of race discrimination by a former employee of a leading manufacturer of fire and safety equipment.
- Guided a large manufacturer through federal and state efforts to investigate the company and generate criminal charges. U.S. ended up dropping the case after nearly five years.
- Developed a comprehensive intellectual property plan that protected a new product line for a leading beverage equipment manufacturer.
- Served as lead counsel for Nationwide Industries, Inc. in two recent patent infringement lawsuits filed in Federal District Courts in California and Florida.
- Mounted challenge in D.C. federal court challenging the enforcement of a federal OSHA regulation that sought to impose increased restrictions on the steel fabrication industry.
- Won summary judgment dismissal of two separate federal lawsuits seeking multi-million dollar damages for alleged breach of warranty in the sale of industrial machines.
- Represented a large manufacturer of chemical additives for the rubber and plastics industries in complying with the requirements of the RCRA program, including RFA/RFI, corrective action and the preparation of a comprehensive risk management plan.
- Represented a chemical company in the decommissioning of a large chemical manufacturing plant that had operated for 100 years; assisted in the remediation and ultimate redevelopment of the plant site under the state Brownfields program.
- Represented two large bourbon distillery companies that had releases into adjoining waters of hundreds of thousands of gallons of bourbon resulting from warehouse fires; assisted with immediate response actions and negotiations with state and federal enforcement agencies.
- Represented steel fabricator in multi-million dollar arbitration arising out of construction of a large paper products manufacturing facility in Missouri.
