  • Assisted a real estate private equity fund's $16-million acquisition and mezzanine financing of two apartment complexes.
  • Assisted a shopping center developer in its acquisition development financing of a grocery store-anchored shopping center in Hagerstown, Md.
  • Worked with a national conduit lender in its real estate-based lending.
  • Counseled a national environmental services company in the purchase of Kentucky's only hazardous waste treatment and storage facility.
  • Counsel to the City of Louisville and The Cordish Company in the $75 million revitalization of Louisville Galleria as 4th Street Live.
  • Assisted with construction financing of apartments, office buildings and industrial properties in Tennessee, Georgia, Florida and Texas.
  • Represented a regional development company in a $45 million REMIC loan with a national lender secured by four shopping centers located in Central Kentucky.
  • Assisted the owner of a prominent Kentucky shopping center in expansion into new markets, a project which included the negotiation and acquisition of shopping centers located in Tennessee, North Carolina and Pennsylvania.
  • Successfully represented a national mortgage loan company before the Kentucky Supreme Court in challenging bar association rules preventing title companies from conducting real estate closings.
  • Continued representation of a national REIT in development and leasing of commercial office space, including recent leases for over 60,000 square feet.
  • Assisted borrower in collateral substitution of office property securing loan of over $188 million.
  • Assisted developer in acquisition, financing, zoning, restrictions and covenants, and sales contract on new development in Middle Tennessee area.
  • Negotiated ground leases with national tenants for owner with Tennessee and Texas properties in newly-developing properties.
  • Represented Kentucky based real estate management company in securing $45.4 million in conduit financing.
  • Our team of state and local tax attorneys have represented a national real estate investment trust regarding income taxation of rental income and dividends paid by the REIT in both Kentucky and Ohio.

Housing Development

  • Assisted privatized joint venture in bond financings with the University of Louisville to construct private student housing.
  • Obtained city of Brentwood, Tenn., approval for first "Innovative Project" residential development, including townhomes, boulevard homes and hilltop estates.
  • Represents the Louisville Metro Housing Authority on property acquisitions and zoning matters in the redevelopment of the Clarksdale neighborhood in Louisville.
  • Lead attorney representing the Louisville Metro Housing Authority in the award winning $200 million HOPE VI Park DuValle Revitalization and the Clarksdale HOPE VI Revitalization.
  • Lead real estate counsel to the Louisville Regional Airport Authority in the Heritage Creek Innovative Housing Program.
