Many employees assume they are completely free to compete in any form of fashion against their employer, so long as they never signed any non-compete, non-solicitation or confidentiality agreement. Rather, employees have a fiduciary duty of loyalty to their employer that arises inherently from the employment relationship.

Since 1998, private owners have made the choice to incorporate sustainable design and construction practices in their buildings by following the LEED Rating System established by the United States Green Building Council (“USGBC”). Starting in 2003, federal agencies began requiring that all new construction within their particular agency achieve a certain level of LEED certification. Since that time, 22 states have now mandated that public buildings achieve certain levels of LEED certification under the LEED Rating System.
